A Kogi State High Court has struck out the assassination attempt case instituted by Senator from the state, Dino Melaye against the chairman, Association of Local Government of Nigeria, Taofiq Isa, instituted

Melaye, had on April 2017 approached the court over alleged assassination attempt on his life by Isa and four others.

Others charged along Isa include, Abdullahi Isah, Ade Obege, Ahmed Ajayi  and Michael Bamidele

The trial judge, Fola Ajayi  has however struck out the matter for lack of diligent prosecution.

Ajayi lamented that in spite of four adjournments, the prosecution was not able to call their witnesses.

Ruling on the matter, Fola Ajayi held that the prosecution counsel could not open his case despite four adjournments, hence he struck out the matter.

However, he gave a consequential order for the prosecution to start their case afresh whenever they are ready.

Reacting on behalf of the defense counsels, Zakari Abbas commended the trial judge for the judgement.

Abbas said, “Hence, the charge brought against the defendants have been struck out. As it stands, there is no criminal charges against the defendants.

“However, he gave a consequential order that whenever they are ready with their witnesses, they could approach the court to start their case afresh.”
